For the first time in Indian Judiciary, the accused who committed the rape on female child was sentenced for life imprisonment and was imposed fine also. On behalf of the accuse, it was argued to pass lesser punishment as the accused was coming from weaker section and was poor, but ,the court held that as said in ‘‘MANUSMRITI” sentence can not be awarded considering the caste of the culprit. Imposing sentence for the proved offense considering the caste of the accused would be against the spirits and real concept of the constitution of India.
